1. Introduction

Welcome to Purelyvibeusa (“we,” “us,” “our,” or the “Site”). By accessing or using our website, products, and services (the “Services”), you agree to be bound by these Terms of Service (“ToS”). If you do not agree, do not use the Services.
These ToS incorporate our Privacy Policy, Shipping Policy, and Return & Refund Policy.

2. Eligibility & Accounts

• You must be 18+ (or the age of majority in your jurisdiction).

• One account per user. Keep your credentials confidential; you are responsible for all activity under your account.

• Provide accurate, complete, and up-to-date information. We may suspend or terminate for fraud or inaccuracy.

3. Orders & Acceptance

• Cart placement or automated confirmations do not equal acceptance. We may refuse/cancel due to suspected fraud, pricing/stock errors, or policy violations.

• We generally process orders within 24 hours (peak times may vary).

• We may limit quantities per order/household/account.

4. Pricing, Taxes & Currency

• Prices may change without notice before acceptance.

• Taxes, duties, and fees (if applicable) are your responsibility and may appear at checkout or be collected on delivery.

• Unless stated otherwise, all charges are processed in USD.

5. Shipping, Delivery & Risk of Loss

• Options and estimates are shown at checkout; see Shipping Policy for details.

• Title and risk of loss pass to you upon delivery to the carrier.

• Outbound shipping fees are non-refundable, unless required by law or specified in our policies.

6. Products & Availability

• We strive for accurate descriptions, but do not warrant that listings, images, or other content are error-free, complete, or current.

• Availability is not guaranteed; items may sell out. We may cancel and refund if inventory issues arise.

7. Returns & Refunds

• We accept returns within 30 days of delivery for eligible items in original condition with tags/packaging.

• Follow the instructions in our Return & Refund Policy.

• Unless the return is due to our error or a defective item, shipping fees are non-refundable and return shipping is your responsibility.

• Refunds are issued to the original payment method after inspection.

8. Cancellations & Order Changes

• Contact us immediately to request changes. We cannot guarantee modifications after submission.

• If processing has begun, you may return according to Section 7 (item eligibility applies).

9. Promotions & Coupons

• Subject to their specific terms and valid only for the stated period.

• We may modify or terminate promotions at any time. Misuse may result in cancellation.

10. Prohibited Use

You agree not to use the Services to:

• Violate laws or third-party rights;

• Infringe intellectual property;

• Post defamatory, abusive, or harmful content;

• Interfere with security, integrity, or availability of the Services;

• Engage in fraud or chargeback abuse.

11. Intellectual Property & Brand Status

• The Site and its content (text, graphics, logos, code, and arrangements) are owned by Purelyvibeusa or its licensors and protected by applicable IP laws.

• Third-party trademarks belong to their owners. Unless expressly stated, we are an independent retailer and not affiliated with, authorized by, or endorsed by those brands. References are for identification only.

12. User Content & Feedback

• By submitting reviews, images, or feedback, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use and display such content.

• You warrant you own the rights and your content does not infringe others’ rights.

13. Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and protect your data.

14. Disclaimer of Warranties

THE SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted, secure, or error-free operation, or complete accuracy of content.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOLIXO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICABLE ORDER IN THE THREE (3) MONTHS PRECEDING THE EVENT.

16. Indemnification

You agree to indemnify and hold harmless Purelyvibeusa from claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these ToS or misuse of the Services.

We are not responsible for third-party sites or services. Access them at your own risk.

18. Changes to Services or ToS

We may update the Services and these ToS. Material changes will be posted with a revised “Last updated” date. Continued use constitutes acceptance.

19. Governing Law & Dispute Resolution

• These ToS are governed by the laws of the State of California, USA, without regard to conflict-of-law principles.

• Disputes shall be resolved in the state or federal courts of San Francisco County, California, and you consent to such jurisdiction and venue.

• Either party may seek injunctive/equitable relief for IP or data-security matters in any competent court.
